Welcome to Pixtor Media Solutions LLC. This document outlines the Terms and Conditions (“Terms”) that govern the use of our website and services. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO COMPLY WITH THE RULES AND POLICIES OUTLINED HERE; IF YOU DO NOT AGREE, DO NOT USE THE SITE OR OUR SERVICES. Please read them carefully to ensure a clear understanding of your rights and obligations. These terms apply to all users of our services, including clients, website visitors, and customers.

“Agreement”: Refers to these Terms and Conditions and any written contracts, invoices, or addenda between Pixtor Media Solutions LLC and the Client.

“Business,” “We,” “Us,” “Our,” or “Photographer”: Refers to Pixtor Media Solutions LLC, including its owners, employees, contractors, and agents.

“Client,” “You,” or “Your”: Refers to the individual, couple, group, or entity booking photography services from Pixtor Media Solutions LLC.

“Session”: Any scheduled time arranged between the Client and the Photographer for capturing images, including but not limited to portrait sessions, events, or weddings.

“Services”: All photography-related offerings provided by Pixtor Media Solutions LLC, including the session itself, image editing, retouching, file delivery, and additional products.

“Images” or “Photographs”: Any photographic work produced by the Photographer during the Session, in either digital or printed format.

“Booking”: The process of reserving a Session by agreeing to these Terms and Conditions and paying any required deposit or fees.

“Fees”: The monetary charges for Services, including session fees, travel expenses, editing fees, transaction fees, taxes, and any other associated costs.

“Deliverables”: The final Images, products, or materials to be provided to the Client after completion of the Services.

1. Definitions

  • By booking our services, you agree to comply with these terms.

  • These terms may be updated periodically; continued use of the site or our services indicates acceptance of updates.

2. General Terms

  • All bookings require a 50% deposit to secure the date and time. This deposit will be applied toward the total session cost.

  • Studio sessions and drone services require full payment to secure a booking date and time.

  • Deliverables will not be sent until full payment is received.

  • Pricing is subject to change; confirmed bookings will honor the agreed-upon rates.

  • Payments must be made using the methods listed on our website. For alternative payment arrangements, contact us at support@pixtor-studios.com. While we may consider other options, we cannot guarantee acceptance of any payment method not currently offered.

3. Booking and Payments

  • Drone services are primarily available for commercial purposes (e.g., real estate, events, construction projects). However, we reserve the right to offer drone services for other purposes at our discretion. Availability is subject to location regulations and weather conditions.

  • All drone operations comply with FAA rules and regulations and the law. Drone services cannot be conducted in restricted areas, such as near airports or within designated no-fly zones. Pixtor Media Solutions LLC will ensure the chosen location complies with FAA rules and regulations and the law.

  • Drone services are subject to additional charges based on the scope of the project, flight time, and editing requirements. These fees will be discussed during booking.

  • Drone footage is captured in high-resolution 4K video or high-quality still images in MP4 or JPEG format.

  • Finalized drone footage and images will be delivered within 14 business days via an electronic link. If there are any delays, we will communicate promptly.

  • Pixtor Media Solutions LLC is not responsible for delays or restrictions caused by weather, technical issues, or location limitations. Clients agree to release Pixtor Media Solutions LLC from liability for unforeseen circumstances affecting drone services.

  • Safety is a top priority during drone operations. If conditions are deemed unsafe, the drone pilot reserves the right to modify or cancel drone services.

5. Cancellations and Refunds

  • Cancellations made 48 hours or more before the booked session will receive a full refund (e.g., for a session scheduled on Friday at 3 PM, cancellation must occur by Wednesday at 3 PM), unless the session has been already rescheduled before. No refunds will be issued for cancellation made less than 48 hour prior to the booked session.

  • If you are more than 15 minutes late, your session may be shortened or rescheduled, subject to a $50 rescheduling fee at the discretion of Pixtor Media Solutions LLC. No-shows will forfeit their deposit and must pay a new deposit to rebook.

  • If we need to cancel or reschedule due to unforeseen circumstances (e.g., weather, studio issues), you will have the option to either reschedule the session without any penalty or cancel for a full refund.

  • All sales are final. Once payment is made and deliverables are provided, no refunds, returns, or exchanges will be issued.

6. Copyright and Usage

  • All images remain the intellectual property of Pixtor Media Solutions LLC.

  • Clients are granted a license for personal use of their images.

  • Commercial use requires written consent and may incur additional fees.

  • Clients must arrive on time for scheduled sessions. Delays may result in reduced shooting time or rescheduling fees.

  • Ensure permission is obtained for shoot locations, if applicable.

  • Same-day location changes are not permitted.

  • Props will not be provided; clients are responsible for bringing their own props.

  • Clients are responsible for any additional fees such as studio fees or photography permits.

  • Any equipment damaged during a session must be replaced or repaired at the client’s expense. Disputes regarding damages will be resolved through good-faith discussions or arbitration.

  • Clients will receive finalized images via an electronic link sent to the email address provided in the booking form within 14 business days after session completion.

  • Physical prints or albums are not included.

  • In case of delays, we will notify clients promptly.

  • By agreeing to these terms, you grant Pixtor Media Solutions LLC the right to use your photographs for marketing purposes, including but not limited to social media and our website.

  • Clients may opt out of marketing usage at the time of booking.

  • If any individuals photographed are under the age of 18, you represent that you are the parent or legal guardian authorized to consent to these terms on their behalf.

  • All text, images, and materials on this website are the property of Pixtor Media Solutions LLC and may not be copied or reproduced without permission.

  • Pixtor Media Solutions LLC is not liable for delays, cancellations, or damages caused by unforeseen circumstances (e.g., weather, equipment failure).

  • Pixtor Media Solutions LLC is not liable for personal injuries, property damage, or losses incurred during the photography session. Clients are responsible for assessing the safety and suitability of locations, props, and activities and agree to release Pixtor Media Solutions LLC from liability.

  • Maximum liability for any claim is limited to the amount paid for services.

  • These Terms and Conditions are governed by the laws of the State of Texas and the United States.

  • If any part of these Terms and Conditions is found unenforceable, the remaining sections remain in effect.
